CBD comes from Cannabis sativa L, an annual herbaceous flowering plant. Cannabis sativa L. is the plant species, and does not mean our products will have the sativa like effects typically associated with those strains of marijuana. Cannabidiol is POSSIBLY SAFE when taken by mouth and appropriately in adults. Cannabidiol doses of up to 300 mg daily have been used safely for up to 6 months. In the United States, cannabidiol is a Schedule I drug under the Controlled Substances Act. This means that production, distribution and possession of CBD is illegal under federal law. In 2016, the Drug Enforcement Administration added “marijuana extracts” to the list of Schedule I drugs, which it defined as “an extract containing one or more cannabinoids that has been derived from any plant of the genus Cannabis, other than the separated resin (whether crude or purified) obtained from the plant.” Previously, CBD had simply been considered “marijuana”, which is also a Schedule I drug. In June 2018, the FDA approved oral use of CBD as an anti-seizure drug in treating rare types of childhood epilepsy. This is a contradiction as Schedule 1 substances by definition have no accepted medical use.

On Apr. 16, 2014, Wisconsin Governor Scott Walker signed AB 726, known as Lydia’s Law, which states that “any physician may provide an individual with a hard copy of a letter or other official documentation stating that the individual possesses cannabidiol to treat a seizure disorder if the cannabidiol is in a form without a psychoactive effect.” A release from the Governor’s office characterizes the law as “clearing the way for a new treatment for children suffering from seizure disorders, pending FDA approval.”
Research is beginning to show that CBD is different than other well-studied cannabinoids. All cannabinoids act as ligands, meaning they dock onto the binding site of a protein and have the ability to modulate a receptor’s behavior. It depends on what kind of hemp oil it is. It needs to be therapeudic grade, not hemp culinary oil. CBD is in my experience and opinion far superior to any other. It is non psychotropic but has all of the healing properties.
The law as written requires physicians to “prescribe” CBD, which would break federal law. States with legal programs allow doctors to “recommend” as opposed to prescribe. However, the Texas Compassionate Use Program says that “prescription” is defined as “an entry in the compassionate-use registry” and three dispensing organizations had been licensed as of Dec. 15, 2017.
As more scientists recognize the compound’s potential, there has been an “explosion of research,” according to Pal Pacher, a pharmacologist and cardiologist at the National Institutes of Health in Bethesda. He has been studying the chemical for more than a decade; his work has shown that CBD may have benefits in both heart disease and diabetes.
As noted in the report by Booth, Page, and Bohlmann, various strains of cannabis plants produce terpenes differently. Commonly, hemp plants contain less terpene-rich resin than marijuana plants. The amount of resin found in hemp plants, however, does not affect the quality of CBD that we obtain from them. In fact, hemp plants are a far better source of CBD than marijuana plants.
The Food and Drug Administration on 6/25/2018 approved the first drug derived from marijuana, which will be used to treat two rare and severe forms of childhood epilepsy. FDA Commissioner Scott Gottlieb said the approval was “a reminder that advancing sound development programs that properly evaluate active ingredients contained in marijuana can lead to important medical therapies.” He noted that the action was “not an approval of marijuana or all of its components” but rather of one specific CBD medication for a particular use. In April, an advisory committee unanimously recommended approval of the drug for the two types of epilepsy.
